| Abstract | This study focuses on protection techniques of planning law which are: the suspensión, verification of the legality and demolition. The work is divided in two distinct parts. First, we clarify what the systematic context of protection techniques within the Urban Law. Then, we rebuild the legal framework within which they operate and the different assumptions that apply. To end the first part of the work, we observe the compatibility of such arrangements with the urban penalty system. Second, we discuss each of these techniques separately to investigate the most problematic aspects that have, focusing on a specific assumption: the execution of works without authorization certificate. Thereby, within the suspensión we will focus on its object and its “immediate”; as for the legality verification we will study the nature of the term that has the Administration to start the record of verification of legality and its díes a quo; and finally, we will show the effect of the principle of proportionality in technique of demolition. |
