Abstract	This article seeks to analyze whether Law 12.015 / 2009, which brings changes to the Brazilian Penal Code in the context of sexual crimes, has contributed to the recognition of the sexual rights of children and adolescents. The initial hypothesis is that the Law was constructed in the absence of understanding the child as a subject of rights. Bibliographical, documentary and jurisprudential research was done as a basis for the analysis. It is evaluated that Law 12,015 / 2009 contributed to reaffirm a tutelary logic that ignores the dimension of children's and adolescents' rights.
