| Abstract | This article discusses the complexity of banking contract in consumer relationships and the vertiginous changes which they have undergone in the last few years as a result of legislative changes and business strategies. It stresses the multiplicity of public and private normative sources, emphasizing the influences that they have in the intra and interdisciplinary context. It analyzes the new parameters for modern banking agreement, including the phenomenon of banking, the technological impacts, the emerging content of the contractual theory, the consumer relationship and contract, the prevention of conflicting suits. It studies the contradictions inherent distributional tensions, applying legal and economic criteria and it suggests a model for prophylaxis in government of banking contracts applied to consumer relations. |
