| Abstract | The thesis assesses the performance of the regulation of and rules for defending competition in the liberalization of fixed broadband telecommunications, and proposes the most appropriate model, placing special emphasis on the models applied in Spain and Europe. In this region, after more than twenty years since the beginning of the liberalization of the sector, there has been very little progress made on the once-hailed, basic goal of gradually reducing ex ante regulation and applying the rules of competition. Moreover, this model has failed to promote real choices of networks that revitalize the market and encourage innovation and investment. The thesis highlights the factors that have led to this situation: apathy on the part of the regulator and regulatory capture, the failure to adapt to the new reality of the sector, insufficient clarification of the roles of sectorial regulators and competition bodies and, above all, the failure to have developed a model of dynamic, self-sustainable competition. After the theoretical and empirical analysis of internationally representative cases, the research proposes a new regulatory focus. The alternatives that are assessed are the following: o Adoption of a model based on competition within a single infrastructure, which requires continuous ex ante regulation (the model of competition in services or intramodal competition) o Adoption of a model based on competition between infrastructures which promotes the development of real alternatives (the model of full competition in networks and services or intermodal competition). The conclusions and empirical evidence of the thesis test the worthiness of reorienting the current regulation towards the second option: a model of a liberalized market on the level not only of services and prices but also real self-sustainable network infrastructures.
