| Abstract | This study has the objective of analyze the regulatory risk in the brazilian telecommunication market since it is recognized that this sector is of prime significance to attract direct investments in the country, having a central role in the context of the technological convergence of the so-called New Economy. For that purpose, the dissertation emphasizes the importance of considering the analysis of the institutions in this discussion. Thus, besides of the economic and financial approach, the regulatory risk is discussed through the political and legal view, highlighting the association of that phenomenon with the credibility lack and arbitrariness of the regulatory decision-making process. After that a simple economic game theory model is proposed to understand the contractual conflicts between the operators and the government, which faces a dilemma between political rents and credibility costs, during the revising tariff process. For last, the analysis focus the fixed telephony and use the mentioned model to investigate several aspects of the legal dispute regarding the validity of the readjust of tariffs of fixed phone calls by the price index contractually defined, which happened during 2003/2004. |
