| Abstract | The main objective of this research article is to analyze the criminal recidivism in Colombia of persons deprived of their liberty in the prison and penitentiary complex of Cúcuta in 2017, for which specific objectives will be considered: the study of the regulations that regulate the punishable behavior of persons deprived of liberty in the prison and penitentiary complex of Cúcuta, determine whether the teaching of academic classes as well as the teaching of crafts and arts as alternative criminal measures fulfill their purpose and explain the controls that are they have on the people who enter as recidivists in the prison and penitentiary complex of Cucuta. The purpose of these objectives is to answer the question "What are the reasons for a person who has served a sentence to become a recidivist?” Based on the above and based on the qualitative nature of the present proposal, an international legal analysis and Colombian regulations and a semi-structured interview with an official of the branch were conducted. Thus, within the different results we find that both international and national law are very safe when it comes to protecting the rights of prisoners in prisons. Similarly, that all prisoners are required to continue their studies and that the teachings taught in the Prison and Penitentiary Complex, are made with a resocializing purpose that guarantees non-recidivism. |
