| Abstract | This present End of Degree Project focuses on the analysis worker ́s information and consultation rights, encompassed in the participatory competencies in the company and whose ownership corresponds to the legal representatives of workers. Rights whose regulation is deeply influenced by community regulations, which aims to promote the effectiveness of these participatory rights and adapt the organization of work to the new forms required by current globalization, making special reference to the 2002/14/CE Directive. The basic core of these rights of information and consultation is set out in the 64 ET Article although it does not depleted its content -, which can be classified according to the subject matter of information and consultation; as well as the article regulates the monitoring function, that the representation has, which reinforces the functions of information and consultation and serves as a control medium of the current legality of business decisions; finally it leaves the conventional way open to expand these participatory rights. Eventually, there will be a brief analysis of the main limit of these rights included in the 65 ET article, the responsibility of stealth and secrecy, and the consequences of the transgression worker ́s information and consultation rights. |
