| Abstract | In the framework of the Social State of right, public authorities have to develop social policies which aim the effective equality between citizens, combat disparities and implement measures to achieve full employment. To this end, the different systems of government procurement are pointed as a suitable tool to promote the development 66 Dereito Vol. 17, n.o 2: 65-90 (2008) of social policies through the introduction of social clauses in these procedures which encourage companies to adopt some measures of social responsibility. Consequently, the present work analyses the treatment of social clauses by the new legal government procurement framework in the different phases of the contractual procedure and, especially, their consideration as contract award criteria of tenders. |
