| Abstract | espanolEl regimen del comercio interior y la defensa de los consumidores y usuarios representan dos claros ejemplos de materias con contornos civiles sobre las que todas las comunidades autonomas han asumido competencias. En este articulo se pretende, de un lado, esclarecer si cabe configurar, a traves del ejercicio de estas, un espacio de regulacion autonomica con incidencia en la esfera del derecho privado y, de otro, clarificar cual es el papel que juega en esta coyuntura la existencia anadida de derechos civiles forales en solo algunos territorios. Un detenido examen de la doctrina del Tribunal Constitucional al respecto —ineludible para dar respuesta a cuestiones como las apuntadas— permite constatar que la lectura que se ha hecho de las competencias constitucionalmente atribuidas al Estado sobre el derecho privado limita por completo, a menudo de forma insuficientemente justificada, la capacidad de las distintas comunidades autonomas para regular la dimension privada de los referidos ambitos normativos. EnglishThe domestic trade system and consumers and users protection represent two examples of multidisciplinary matters on which all the Autonomous Communities have assumed competences. This article aims, on one hand, to clarify if it is possible to set up, through the exercise of these competences, a space for autonomic regulation with incidence in the private law area and, on the other hand, to know what is the role, at this juncture, of the added provincial civil rights only in some territories. A close examination of the Constitutional Court doctrine about this matter —unavoidable in order to give answers to the forenamed questions— allows us to verify that the lecture that has been made about the competences constitutionally conferred to the State about private law limits completely, often in a non-sufficiently justified way, the ability of the different autonomous communities to regulate the private dimension of the forenamed normative fields. |
