Abstract	espanolEn relacion al contrato de fiducia, es relevante para el derecho del consumo establecer los elementos que categorizan un contrato como el de adhesion. Esto, toda vez que la calidad adhesiva del clausulado en este tipo de contratos determina la activacion de los mecanismos de control de clausulas abusivas, como la obligacion de presentar el modelo de contrato ante la autoridad administrativa para su revision y aprobacion. Ademas, tratandose de un negocio fiduciario, una clausula solamente podra ser considerada como abusiva en cuanto se encuentre estipulada en un contrato de adhesion. En virtud de lo anterior, y de las particulares caracteristicas del contrato de fiducia se hace necesario el analisis particular de los elementos que determinan el caracter adhesivo de un contrato en este tipo contractual. Los principales elementos a considerar son el caracter masivo del contrato, la negociacion con el cliente final, el margen de negociacion de sus estipulaciones y la posible existencia de fideicomitentes adherentes en relacion con las normas que regulan al negocio fiduciario, los derechos que la ley comercial le otorga a los fideicomitentes y las obligaciones del fiduciario. EnglishIn regards to the trust agreements, it is relevant for consumer law to establish the elements that categorize a contract such as an adhesion contract everytime the adhesive quality of the clauses in this type of agreements determines the activation of control mechanisms of unfair terms, like the obligation of submitting the contract model to the administrative authority for its revision and approval. In addition, as it is a fiduciary trust business, a clause will be considered unfair only when stipulated in an adhesion contract. On that basis and taking into account the special characteristics of the trust agreements, it is necessary to examine in detail the elements that determine the adhesion nature of a contract within this contractual type. The main elements to be considered are the massive nature of the contract, the negotiation with the final customer, the margin for negotiation of its stipulations and the possible existence of adherent settlors in relation to the norms that regulate the fiduciary business, the rights that the comercial law grants to settlors and the obligations of the trustees.
