| Abstract | The presents Graduation Final Work studies and develops the possibility of a minor (a person under eighteen years old) might present a formal complaint of domestic violence either as victim or as family member when someone else is the victim. In order to reach this objective, it will be necessary to relate the legal concept of family violence, parent's power adjustment (according to the Article N° 278 of the Argentine Civil Code) and the concept of progressive capability, everything inside the prescription of the Convention on the Rights of the Child; emphasizing the importance and seriousness of domestic violence, the accusation's formal requirements, who can present a complaint, and the process we must follow to report acts of domestic violence when the victims are minors. In this work I am going to analyze Law No. 24,471, Law No. 39 of the Province of Tierra del Fuego, Law No. 6672 of the Province of Mendoza and complementary rules imposed by Mendoza's Supreme Court of Justice. |
