| Abstract | This research was developed in three chapters: The first chapter makes a historical overview of the legal dispensation in the Church that shows the evolution of the concept and policy from its origin to the current formulation in the current Code. The second chapter talks about the study of immunity, making a comparative rato and unconsummated in the Codes of Canon Law, based on the context of the waiver in general, showing the delimitation of this issue within the Code as the development of its legal process, as well as the competent authority. In the third chapter a foundation of pastoral and salvific aspects of matrimonial dispensation while and not consummated, through the various magisterial Church documents that refer to the sacrament of marriage, the family, the indissolubility and the alliance is presented. The methodology used In the preparation of this research was based on historical, comparative and explorative methodology, through and through these guidelines, it has reached a number of conclusions that allow us to discover the role of the Church among the faithful as a legal entity of great pastoral mediation and attention of its members, which throughout history has been structuring and strengthening its legal organization. |
