| Abstract | RESUMO O nosso ordenamento juridico permite, na hipotese da ocorrencia de uma prisao em flagrante de uma pessoa, que o Juiz conceda a liberdade provisoria do preso, com ou sem a fixacao de fianca. Excepcionalmente, o Delegado de Policia pode fixar a fianca, nas hipoteses do artigo 322, do Codigo de Processo Penal. Entretanto, com a regulamentacao das audiencias de custodia no Brasil, o presente estudo objetiva analisar se o instituto da fianca sofreu alguma alteracao com a Resolucao no 213/15, do Conselho Nacional de Justica. ABSTRACT Our legal system allows, in the event of the occurrence of caught in the act of a person, that the judge to grant the release on own recognizance of the prisoner, with or without fixing bail. Exceptionally, the Police Officer may set bail in the cases of Article 322 of the Criminal Procedure Code. However, with the regulation of custody hearings in Brazil, this study aims to examine whether the bail institute underwent a change with Resolution No. 213/15 of the National Council of Justice. |
