| Abstract | “Super-precedent” (or, synonymously, “super stare decisis”) has crept into our usage lately, primarily through its use—along with “super duper precedent”—in the interrogations of Chief Justice Roberts and Justice Alito before the Senate Judiciary Committee. Of course the cases that focused this attention were Roe v. Wade and its principal successor, Planned Parenthood of Southeastern Pennsylvania v. Casey, the point being to solicit acceptance of such precedent from the nominees.
