Abstract	Sovereign funds, which are created and controlled by states, cannot be considered to be ordinary investors. Their “sovereign” origin makes it diffi cult to identify them with respect to international law, despite the “private” nature of their activities. The host states of their investments take protective measures against them, as if they suspected them of pursuing primarily political objectives. It has to be observed, however, that such measures are of debatable legality with respect to international instruments for bringing about a free-market economy, and that recent initiatives to effectively ring-fence this new state capitalism have still left gaps. « [A]t least, be nice to the countries that lend you
