| Abstract | espanolMexico forma parte de los Estados que han ratificado el Estatuto de Roma del cual nace la Corte Penal Internacional. Para que esto pudiera materializarse la Constitucion Politica de los Estados Unidos Mexicanos sufrio una reforma en su articulo 21, en el cual se reconoce la jurisdiccion de dicha Corte. En ese sentido, el analisis que aqui se realiza, gira en torno precisamente a la entrada en vigor del Estatuto de Roma en el sistema juridico mexicano. El proposito versa sobre identificar los alcances que tiene dicha reforma constitucional de cara al Derecho Internacional Publico y ante el propio Estatuto y si en su caso, la multireferida reforma se constituye per se como una reserva al Estatuto de Roma o bien debe ser leida como una expresion constitucional que al insertarse en la Carta Magna debe prevalecer. EnglishMexico is one of the States that have ratified the Rome Statute from which the International Criminal Court is born. In order to materialize that, the Political Constitution of the United Mexican States suffered an amendment in Article 21, which recognizes the jurisdiction of the Criminal Court. The object of this analysis is precisely the entry into force of the Rome Statute in the Mexican legal. The purpose is to identify the scope of this constitutional amendment with regard to Public International Law and the Statute itself, and if the multi-referenced amendment is per se a reservation to the Rome Statute or should be read as a Constitutional expression that must prevail in the constitution. |
