| Abstract | RESUMO Essa pesquisa tem por escopo analisar o problema do trabalho escravo no Brasil, com destaque para o avanco proporcionado pela Emenda Constitucional (EC) 81/2014 que preve como sancao aos responsaveis pela submissao de individuos a condicao analoga a de escravo, a expropriacao de suas propriedades. Para tanto, e usado o materialismo dialetico como corrente metodologica a fim de conhecer o que representa a escravidao para cada sistema de producao vigente em dado momento, e o metodo dedutivo de conhecimento. Relatorios recentes da OIT estimam que cerca de 12,3 milhoes de pessoas sao vitimas de trabalho escravo, apesar de sua vedacao absoluta no âmbito do direito internacional e dos mecanismos juridicos existentes para combate-lo. A partir disso, e possivel verificar o avanco que representa a EC 81/2014 na busca de se erradicar o trabalho escravo. Entretanto, o progresso so sera possivel caso seja afastada qualquer iniciativa de mudanca da conceituacao de trabalho escravo, dada perfeitamente pela legislacao penal. ABSTRACT THE PROBLEM OF THE SLAVE LABOR IN THE CONTEMPORARY BRAZIL IN THE LIGHT OF THE CONSTITUCIONAL AMENDMENT N. 81/2014 This research paper analyzes the issue of slave labor in Brazil and the legal instruments to fight against this practice, highlighting the advances brought by the approval of the Constitutional Amendment that provides, as a sanction, the expropriation of the properties of the people responsible for the submission of individuals to conditions analogous to slavery. For that, dialectical materialism is used as a methodological stream in order to know what slavery represents to each current production system at a given moment, and the deductive method of knowledge. Recent reports from the ILO estimate that about 12.3 million people are victims of slave labor, despite its absolute forbiddance on the scope of International Law and the existing legal mechanisms in each State to fight against it. Thus, it is possible to verify the innovation that the new Constitutional Amendment represents on the attempt to eradicate slave labor. However, progress will only be possible if any attempt to change the definition of slave labor, which is perfectly given by the criminal law, is repelled.
