Abstract	This article is about the judicial precedents and its effectiveness in the current legislation. The research begins with the verification of Civil Law and Common Law systems. Subsequently, there is a conceptualisation of the institutes “ratio decidendi” and “obter ditum”. Therefore, from this, it is possible to observe the application of the precedents in the Civil Procedural Code of 2015, and the effectiveness of judicial precedents is verified in guaranteeing legal security.
