| Abstract | The work is a reinterpretation of contract and seeks to draw a functional and promotional profile of the institute, seeking a contract design that expresses the constitutional principles. The contractual model that is proposed is one in which also contains the concern with a solidaristic purpose that guides the constitutional system. The work will address briefly the historical evolution of the contract and will examine the roles it should play in contemporary society, especially the social function. In this context, will be examined the dynamics of the contractual relationship that connects directly to society and to the environment. Thus, permeating the social function of the contract, it defends the idea that the contract is an instrument that should reflect the solidaristic ideals of the constitutional order and that should collaborate for the sustainable development. |
