| Abstract | Among the provisions of the Rome Convention on the Law Aplicable to Contractual Obligations Article 4, that establishes the applicable in the absence of choice, raises very controversial issues. This study discusses the objectives of this provision, the interaction between the principle of proximity and the presumptions paying special attention to the functioning of the characteristic performance and to the determination of the country that is most closely connected to the contract in case the presumptions are not applicable - Entre las disposiciones del Convenio de Roma de 1980 sobre la ley aplicable a los contratos internacionales su articulo 4, que establece los criterios para determinar la ley aplicable en defecto de eleccion por las partes, resulta especialmente controvertido. Este estudio analiza el fundamento de esa disposicion, la interrelacion entre el principio de proximidad y las presunciones, con especial atencion a la concrecion de la prestacion caracteristica y a la precision de los vinculos mas estrechos cuando las presunciones no resultan aplicables o es preciso corregir el resultado al que conducen con base en el principio de proximidad. |
