| Abstract | This article analyses if Economic, Social and Cultural Rights of vulnerable groups could be incorporated at the hard core of universal and cogent norms described by the International System of Human Rights Protection as Jus Cogens, particularly at the jurisdiction of the Inter- American Court of Human Rights. We've reached the conclusion through the review of three cases from said court: the first case concerns gender violence (Case of the Miguel Castro- Castro Prison versus Peru); the second one concerns rights and guarantees of humans with disabilities and the fight against discrimination (Case Ximenes Lopes versus Brazil); and the third one is about rights and guarantees of indigenous people, recognizing ESCR of vulnerable groups as Jus Cogens |
