| Abstract | En espanol A traves de un recorrido por los sistemas internacionales de derechos humanos que existen en sede universal y regional, asi como de un analisis comparativo entre los que presentan mayor grado de eficacia en la tutela de tales derechos (los sistemas europeo e interamericano), se ha estudiado la cuestion de la capacidad procesal de los individuos para acceder e intervenir ante organos internacionales de proteccion de los derechos humanos. El analisis de conjunto permite concluir que asistimos a la instauracion de un nuevo paradigma, cual es la consolidacion de la subjetividad juridico internacional del individuo, principalmente en materia de derechos humanos. En ingles This article studies the legal capacity of individuals to intervene before international organs of human rights protection. This is done through an overview of the international human rights systems at regional and universal level, as well as through a comparative analysis of those which show the highest degree of efficiency (European and Inter-American systems). The holistic analysis carried out allows the author to conclude that we are witnessing the onset of a new paradigm, namely, the consolidation of international juridical subjectivity of the individual, mainly as regards human rights. |
