La gestión integral de recursos hídricos en el Perú: el caso de la comisión de regantes del margen derecho del río Chumbao

| Abstract | espanolEn esta investigacion mostramos cuales son las estrategias organizativas de los actores vinculados a la gestion local del agua de riego, en el contexto de implementacion de la politica de gestion de los recursos hidricos del Peru, aprobada el ano 2009. A partir del estudio del caso de una organizacion de riego denominada, "La Comision de usuarios de riego Margen Derecho del rio Chumbao", identificamos y analizamos los conflictos y las tensiones subyacentes a esta organizacion en torno al uso y a la gestion del agua de riego durante el ano 2014. Utilizamos el enfoque de interlegalidad para mostrar que la gestion del agua de riego esta a cargo de las organizaciones sociales y estas han tomado normas de legalidades tradicionales y creando sus propias normas de organizacion. Sin embargo, no responden a un ordenamiento juridico propio, si no a la interrelacion de una legalidad construida, dinamica que negocia constantemente con la legalidad estatal. EnglishThis article uses one case studies to illustrate how a specific Andean smallholder community named "Comision de Usuarios de Riego Margen Derecho del rio Chumbao" uses organizational strategies of the actors linked to the local management of irrigation water, in the context of the implementation of the general water policy reform. This qualitative research focuses on identifying and analyzing the conflicts and tensions underlying this organization around the use of irrigation water management during 2014. Conflicts and tensions are paramount to any analysis of institutions and provide valuable information about the central resources at stake and the power struggles around them. To analyze the performance of irrigation user organizations and their relationship with State institutions regarding water resources management, I have chosen to take an institutional focus and to incorporate concepts from the sphere legal pluralism and interlegality into my analysis. The implementation of this new policy is ongoing and, as with this type of reform, it is producing a mixed set of outcomes, where conflicting interests and positions are at stake. It is a state of legal pluralism, where the State's perpetual incapacity to govern its whole territory is manifested. |
