Abstract	The Theory of Systems thought by Niklas Luhmann which grounds Günther Jakobs theory normative-systemic functionalism, the Criminal Law of the Enemy is discussed in this text. To analyse the theory is used critic lenses, which vehemently rejects any theory that would lower the individual to a subhuman condition as intended by the criminal law of the enemy. Using the method of literature review, the way will be traced in order to demonstrate the incompatibility of the criminal law of the enemy with the rule of law.
