Abstract	The mediation and conciliation, as a tool to helping the parties in a dispute to reach agreement, can promote access to justice. When the parties creates the agreement, they can know their rights, responsibility and duties against each other, instead of submit to state enforcement. The Civil Procedure Code aims to establish a culture of agreement in Brazil and prioritizes this kind of solution of disputes. It’s new in Brazil, so is important to understand the principles of mediation and conciliation. The principles show the way and guide the activities to be developed by mediators and conciliators in whole national territory.
