| Abstract | The dissertation is about how International Law regulates illegal inmmigration and how influences European Union migration system. European Union officials understand that illegal immigration is caused by international push pull factors, that is avoidable and that mafias are the main responsible for phenomenon. This vision appears in European Union documents and many Declarations in European summits. European Union deals with immigration mostly in their international dimension. International law treats migration in two aspects. The first one is related to the movement of people and the second one is related to the human rights of migrants. International law recognises the right of States to control their population but also the human rights of migrants, specially after the approval of 1990 UN Convention for the protection of the human rights of all migrant workers. But, How International law influence the European Union migration system? After 1990 Europe has devoloped a generous integration discourse about immigration. This discourse includes clear references about free movement of people in a global world and of course the respect of human rights of everybody, although not specifically illegal migrants. However this discourse only has had a limitation effect on legislation concerning immigration inside the European Union. It has been less effective on legislation on borders and much less on policy and legislation affecting foreign policy. In fact, great part of economic aid to third countries surrounding European Union is directed to improve their efficiency against illegal migration crossing their territory. The main objetive is stop migration before arriving Europe, where humanitarian concern and lack of resources can made very difficult to return them to their countries. May be is not Fortress Europe but certainly is very close. |
