| Abstract | La introduccion de la agravante generica por el uso de arma de fuego al Codigo Penal Argentino, efectuada por el legislador mediante el articulo 41 bis, desato un gran conflicto en torno a la norma y su relacion con el principio de legalidad y su derivado de lex certa. En el presente se procura realizar un examen de la cuestion a partir de la elaboracion doctrinaria y jurisprudencial existente al respecto. Abstract The introduction of the generic aggravating for the use of a firearm to the Argentine Penal Code, made by the legislature through the article 41 bis, unleashed a great conflict around the standard and its relationship to the principle of legality and its derivative of lex certa. In the present efforts are made to conduct a review of the issue from the doctrinal interpretation and existing case law in this regard.
