| Abstract | This research aims to present the reader from a constitutional law and jurisprudence look, alteration called moral damage to the conditions of existence, that in some circumstances the suffering members of the army in compliance with a constitutional mission and / or development of a military operation and as a result of this, it affects their physical integrity and their family and social environment, and the development of their daily lives in their every dimension. The overall objective of this research aims to analyze the level of responsibility of the state to repair the incontrovertible fact regarding this non-pecuniary damage, considering that there are legal loopholes in the legislation that prevents indemnify the nature of this moral damage. To achieve this purpose, investigate and analyze the theoretical foundations, concepts and jurisprudence on materials, immaterial or moral damage and disruption to the conditions of existence, which can determine if the State responsible for compensating the losses from damage called altered the conditions of life for members of the National Army that has gone on this subject, considering that the damages must be comprehensive, that is, according to all human dimensions. |
