| Abstract | The reform of the Bankruptcy Act 22/2003 of 9 July (Ley Concursal) in Spain has one significant and original aspect but questioned: the labour competences granted to the Judge of bankruptcy proceedings. Considering companies in bankruptcy, such Act grants substantial modification of the working conditions, cease and collective dismissal, with similar procedures foreseen under the Workers’ Statue (Estatuto de los Trabajadores). The focus of the present study is to examine our prevailing poor legal regulation and administrative judicial proceedings. The Judge’s adjudge in bankruptcy proceedings, effects of his declaration in administrative judicial proceedings, affected workers, in which cases workers can oppose and demand redundancy procedure upon the Judge, its processing, or controversial collective resolution of individual contracts, judicial resolution and impugnation are the some of the key issues analysed in the present study. |
