| Abstract | Central Register of Restructuring and Bankruptcy as an ins tu on facilita ng the pursuit of claims in restructuring and bankruptcy proceedings Th e article discusses the assumptions and functions of the Central Register of Restructuring and Bankruptcy, which is to enable it to make notices and postings of decisions, orders and documents issued in the course of bankruptcy and restructuring proceedings. It has been noted that the legislator distinguishes between the notion of publication and posting in the Register. Th ese institutions sometimes refer to diff erent provisions, orders and documents and have diff erent legal consequences. It was noted that the provisions on the Register have not yet entered into force. According to the wording of art. 455 of the Restructuring Law, until the day on which the Register is created, the Court and Commercial Gazette, while the orders and documents to be included in the Register shall be delivered to the Court Registry, which shall be mentioned in the operative part of the order with the date of presentation. During the transitional period, letters and documents are submitted to the case fi le in paper form, although the Act provides that the letters or documents may be submitted in electronic form. Th e register is to improve bankruptcy and restructuring proceedings, enable faster implementation of the claim and increase the level of its satisfaction. |
