| Abstract | In 2015, an amparo was filed before the Argentine Justice in favour of Sandra the orang-utan, prisoner in the city of Buenos Aires Zoological Garden, which is the first time that our Courts have been faced with its potential use in this way, regarding a Nonhuman Animal (NHA). The present piece will examine whether, in accordance with the country's legislation, this selected legal tool could turn out to be the most appropriate for obtaining firstly the Recognition of Fundamental Rights for NHA and, as a consequence of such recognition, the liberation of those for which this action has been initiated, given that Liberty is essential for and inevitably part of the aforementioned Rights. The case initiated for Sandra had two legal hearings, which will be analysed in detail. Finally, the conclusions formed from this examination will be presented. |
