Abstract	espanolEnsayo que en tres partes analiza el deslinde de competencias entre la Sala Constitucional de la Corte Suprema de Justicia y el Tribunal Supremo de Elecciones. La primera desarrolla cuales son las competencias dadas por la Constitucion y por la ley a la Sala Constitucional frente al Tribunal Supremo de Elecciones. En segundo lugar, analiza, si la jurisdiccion constitucional violento con su voto de mayoria el Derecho de la Constitucion al emitir la sentencia que anula la resolucion del Tribunal Supremo de Elecciones, que autorizaba la recoleccion de firmas para convocar un referendum sobre el proyecto de ley denominado �Ley de union civil entre personas del mismo sexo�. Posteriormente, en una tercera parte, aborda un asunto reciente como es lo relativo a la accion de inconstitucionalidad de la ex diputada Mauren Ballestero Vargas contra el articulo 262 del Codigo Electoral. EnglishA Three-part essay that discusses the demarcation of powers between the Constitutional Chamber of the Supreme Court, and the Supreme Tribunal of Elections. The first part deals with the powers granted by the Constitution, and by the law to the Constitutional Court versus the Supreme Tribunal of Elections. Secondly, it analyzes whether the constitutional jurisdiction violated with its majority vote the right granted by the Constitution to issue a ruling overturning the decision of the Supreme Tribunal of Elections, which authorized the collection of signatures to call for a referendum on the bill called "civil union law between people of the same sex. " Later, in a third section, the essay addresses a recent case regarding the unconstitutionality action of the former deputy Mauren Ballestero Vargas against Article 262 of the Electoral Code
