The methodology used was Bibliographic, with the selection of books and articles on the theme. The mediation as alternative means of conflict resolution can also contribute to the improvement of the existing legislation, emerging as an alternative jurisdiction recognized by the Federal Constitution as a legal instrument capable of settling the conflicts of interest, once frustrated possible negotiation between the litigant parties. The institute of mediation, however, is still little used, or even unknown, by most the population, mainly due to the lack of information and of encourage of the use of non-judicial means of resolving disputes. The use of alternative means such as mediation serves, if not to resolve, at least try to minimize the collapse of judicial process of resolving conflicts aggravated by the increase in the number of demands in different spheres of the judiciary. |
