Abstract	The present dissertation was prepared by Danilo Lovisaro do Nascimento and presented to Santa Catarina Federal University to get his Master of Law. The investigated subject concerns to biopiracy at the region of Amazon’s bacin and to the legal instruments that can enforce the juridical protection to biodiversity and associated traditional knowledge. It analyses the negative consequences of biopiracy to developing countries and, specifically, to the Amazon’s region countries, emphasying the threat that this practice represents for the accomplishment of a regional strategy, related to the sustainable use of biodiversity, as an alternative to development. It sustains biopiracy criminalization need at an internal level as an essential stage to the empowerment of a juridical framework for protecting biodiversity at nacional and subregional levels. Based on this premise and wishing approach the question by a complex perspective, which focuses the phenomenon by its totallity, it is presented a complementary proposal to struggle against biopiracy and to ensure its own protection, through the realization of international cooperation to development. To this aim, it is proposed that Amazon Cooperation Treaty Organization be a privilegious forum to the realization of cooperation strategies on behalf of a making of decision at international plan that ensures the accomplishment of an efficient regional project to carrying out a sustainable development at subregional level.
