| Abstract | There is a strong decline in the shark, ray and skates populations worldwide. In Europe various conservation organizations have expressed concern in regard to this decline. The lobbying activities of these organizations have led to action of the European Commission. One of the results of this action is the inclusion of shark, ray and skate species in the Marine Strategy Framework Directive. This obliges the Ministry of Economic Affairs to start in 2015 with implementing a conservation plan for sharks, rays and skates on the Dutch continental shelf. To do so the Ministry of Economic Affairs has called upon the Dutch Elasmobranch Association (DEA) for help. Together with the LEI institute this organization has been given the assignment to give an advice on measures which can be incorporated in the shark, ray and skate conservation plan. This plan will be written with the help of stakeholders involved with skates, rays and sharks on the Dutch Continental Shelf. The involvement of stakeholders in the form of a feedback panel should lead to a better conservation plan which is supported by the involved parties. This report will describe which conditions and criteria the process around and the feedback panel itself have to meet to be successful. The report has the following aim: ‘To give an advice to the NEV on the composition and conditions for a good functioning feedback panel, which has the aim to give advice on and to generate support for the shark, ray and skate conservation plan.’. This aim is achieved by completing a desk study and various interviews with experts on stakeholder processes. Because of the premature state of the stakeholder process we decided not to contact stakeholders. First the conditions for a successful stakeholder process were set up. Then criteria that the participants of the feedback panel have to meet are drawn up. A successful stakeholder process consists of three phases: preparation, the process itself and evaluation. Each phase consists of a number of steps which have to be completed, if this is done the chance of a successful stakeholder process will be enlarged. The most important criterion participants of the process have to meet is that they need to have mandate to speak and to make concessions on behalf of the members of the organization they represent. Apart from mandate it is important that members of the feedback panel actively participate. Next the groups which are involved with sharks, rays and skates on the Dutch continental shelf were analysed. Stakeholders can be divided into the following groups: the fishing industry, nongovernmental organizations, research institutes and ‘other stakeholders’ (consisting of the Ministry of Economic Affairs and ‘Sportvisserij Nederland’). Particularly the fishing industry benefits from participation in the feedback panel since they will be greatly influenced by the conservation plan. Other parties will be less influenced by the conservation plan. When taking the criteria ‘mandate’ and ‘participation’ into account the feedback panel should consist of the following members: VisNed, CVO, Nederlandse Vissersbond, PFA, Waddenverenging, Stichting de Noordzee, Vereniging Kust en Zee, LEI, IMARES, Ministry of Economic Affairs (department of fisheries and the department of nature) and Sportvisserij Nederland. Participation of Jongerennetwerk Visserij is optional. Finally a neutral participant who can be the leader of the stakeholder process and the feedback panel must be attracted. In conclusion a good process consists of three phases: preparation, the process itself and evaluation. Before the process starts, the motive to start the process, the aim, scope, roles and functions of members, deadlines and costs must be validated for the participants of the process. Participants have to be cooperative, be prepared to do concessions and must have the funds to participate actively. The most important feature is that they have to the mandate to speak and to do concessions on behalf of the members of the organization they represent. Finally, it is important that representatives prepare themselves for meetings and that they keep their organizations updated. Improvements and corrections that can be made in this report are the following. When writing this report stakeholders were not contacted, which has an effect on the quality and advice provided in the report. Before starting with the stakeholder process it is important carry out a more complete assessment of the situation by contacting involved stakeholders. The DEA mentioned the organization plans to organize three meetings, we advise to add a preparing and evaluating meeting. This report does not give an advice on a leader of the feedback panel, this is because it is only possible to do so when there is more clarity about the rest of the process. Before the process is started there has to be made sure that the role of the NEV within the process is clear with participants. We also advice the DEA to keep distance from the stakeholder process. During the process the leader of the feedback panel should be aware of miscommunication. Finally, the success of the stakeholder process relies heavily on inside knowledge of the fishing industry. Sharing of this knowledge can have negative consequences for the fishing industry itself, so the gains of participation in the feedback panel for this group have to be made clear. Also, the role of research institutes has to be made clear to the rest of the participants and they should be honest about the lack or incompleteness of current knowledge. |
