| Abstract | DOI: 10.12957/rdc.2018.31112 O presente estudo se propoe a responder o seguinte problema de pesquisa: Como e organizada a politica de zoneamento especial urbano pelo Municipio de Recife? Para responder essa questao, o estudo precisa considerar o conceito de regularizacao fundiaria, realizacao do direito a moradia e judicializacao de politicas publicas voltadas a regularidade da habitacao urbana. O estudo tambem possui o objetivo de esclarecer aspectos sobre a regularizacao fundiaria como politica publica. A pesquisa e qualitativa e realiza analise descritiva com base em revisao de literatura e interpretacao da legislacao sobre o tema; utilizando o Municipio de Recife como unidade de analise e limite espacial de investigacao. Ha suporte quantitativo complementar, a partir da exposicao grafica dos dados coletados. E possivel concluir que, no Municipio de Recife, a politica de zoneamento especial urbano e conduzida a partir da criacao de areas isoladas, com poucos mecanismos de integracao social e sem controle efetivo sobre a expansao urbana, o que exige a intervencao da judicializacao das politicas publicas voltadas a regularizacao fundiaria. Abstract This study aims to answer the following research problem: How is the policy of special urban zoning organized by the Municipality of Recife? To answer this question, the study needs to consider the concept of land regularization, realization of the right to habitation and judicialization of public policies aimed at the regularity of urban housing. The study also aims to clarify aspects of land regularization as public policy. The research has a qualitative approach and performs descriptive analysis based on literature review and interpretation of legislation on the subject. The research focuses on a case study, using the Municipality of Recife as unit of analysis and spatial limit of investigation. There is complementary quantitative support, from the graphical exposition of the collected data. We concluded that, in the Municipality of Recife, the policy of special urban zoning is conducted from the creation of isolated areas, with few mechanisms of social integration and without effective control over urban expansion, which demands The intervention of the judicialization of public policies aimed at land regularization.
