Esta reconstruccion nos permitira demostrar la inviabilidad de la teoria funcionalista de Gunter Jakobs frente al objeto de proteccion en un Estado Social de Derecho, democratico, participativo y pluralista, fundando en el respeto a la dignidad humana, la prevalencia del interes general y en el trabajo (como es el caso colombiano segun la Constitucion de 1991).%%%%Abstract. This paper, aims to reconstruct criminal legal thought around the object of protection and the relationship of this concept with the concept of “bien juridico”. This work allow us to demonstrate the infeasibility ok the functionalist theory of Gunter Jakobs to protect a Social Law State, with the next characteristics: democratic, participatory and pluralistic, founded on respect for human dignity, the prevalence of general interest and the work (as Colombia). |
