| Abstract | espanolEn este trabajo se estudia la plasmacion que en las propuestas oficiales de modernizacion del Derecho espanol tiene la clasificacion de las obligaciones de hacer entre las de medios y las de resultado. Mas precisamente, se analiza si dicha diferenciacion es tenida en cuenta para delimitar tipos contractuales, del mismo modo que, conforme al Derecho vigente, se distingue entre contratos de arrendamiento de servicios y contratos de obra. Tras estudiar las diferentes posturas que al respecto han recogido los textos de Derecho contractual europeo, tanto los que no acogen esta clasificacion (Principles European Law Services Contracts y el Draft Common Frame of Reference), como los que si la toman en consideracion (Propuesta de Reglamento para una normativa comun de compraventa europea y el Codigo de Pavia), se expone en que medida han influido en las propuestas oficiales de modernizacion del Derecho espanol en materia de contratos de servicios. EnglishIn this paper, we study the implementation that in the official proposals of modernization of Spanish law has the classification of the obligations of conducts and obligations of result and if this classification is taken into consideration to delimit contractual types, in the same way that, according to the current law, there is a difference between services contracts and contract for a specific result. This paper studies the different positions that the texts of European Contract Law have adopted in this respect, from which they do not accept this classification as the Principles European Law Services Contracts and the Draft Common Frame of Reference, to those that do take it into consideration as the Proposal for a Regulation for a common European sales law and the Pavia Code. |
