Abstract	Scientific discussion about the effects of globalization on the theoretical basis of the Modern Constitutional State and its traditional concept of Sovereignty. a general over - view on the mutations suffered by the Modern Constitutional State and its current crisis including the weakness of the concept of rights protected by sovereign constitutions starting from the rupture of the paradigms by the capitalist liberal reality imposed to the world after the colapse of the communist Eastern Europe. The article also deals with the possibilities to overcome the Modern Constitutional State.
