| Abstract | The transposition into Spain of the Remedies Directives has resulted in the recognition of a new pre-contractual remedy, the so-called special remedy in public procurement. This pre-contractual remedy ensures a rapid and effective mean of redress when bidders consider that contracts have been awarded unfairly.
