| Description | While some authors posit that ova donation and surrogacy are usefully understood as reproductive labour in the globalised bioeconomy that needs to be adequately regulated to protect egg-donors, surrogates and children, other authors argue that these practices constitutes another form of organ trade and trafficking in women and children which should be banned. In light of this, this chapter sketches the developments in India and argues that these practices are a form of reproductive trafficking that requires new laws and policies that deal with the vulnerabilities of both reproductive third parties and children involved. While some authors posit that ova donation and surrogacy are usefully understood as reproductive labour in the globalised bioeconomy that needs to be adequately regulated to protect egg-donors, surrogates and children, other authors argue that these practices constitutes another form of organ trade and trafficking in women and children which should be banned. This chapter sketches the developments in India and argues that these practices are a form of reproductive trafficking that requires new laws and policies that deal with the vulnerabilities of both reproductive third parties and children involved. Opinions differ as to whether commercial egg donation and surrogacy are to be viewed as reproductive labour or reproductive trafficking. Since 2002, a reproductive industry has developed in India to assist reproduction, where egg donors and surrogates enter transactions in reproductive body parts with intended parents, mediated by service providers for mutual benefit and profit.
