| Description | The verdict of the Constitutional Court No. 140/PUU-VII/2009 rejects the petition of the petitioner for all, in its consideration Paragraph 3.61. Existence of religion that has been recognized by the state becomes an obligation for the state to protect it from misuse. According to the Court, there is no authority for the state to not recognize the existence of a religion because the state must guarantee and protect the religions embraced by the people of Indonesia. Law No. 1 of PNPS 1965, which has been examined by the material in the Constitutional Court in its consideration of Paragraph 3.33, is still urgently needed and substantially relevant, although it needs to be formally improved. The regulation of religious crime is important because it is the embodiment of the first precept in Pancasila – belief in the One Supreme – which means that in Indonesia, religion is the main aspect of society. Ahok's speech, which caused turmoil in the community, was categorized as a crime of religious blasphemy by the Central Jakarta District Court with a verdict of two years in prison. The Constitutional Court has a stake in guarding against the blasphemy of religion in a pluralistic society by defending Law No. 1 of PNPS 1965.
